If you cancel within the cooling-off period, you will not have to pay us anything.

When a complaint for mis-sold PPI or a mis-sold PBA is upheld, the provider must refund you the premiums paid plus statutory 8% interest for each year you held the policy or account. This is designed to put you back in the financial position you would have been in had you not had the policy in the first place. This 8% interest is considered savings interest and is therefore subject to tax like money you earn from a normal savings account.

In 2016 the government introduced the Personal Savings Allowance (PSA), allowing basic rate taxpayers the ability to earn up to £1,000 in savings interest without paying any tax. As most people do not earn anywhere near this amount through standard savings products, the PSA typically covers the interest that was added as part of their PPI or PBA compensation and as such should not have been taxed.

The same principle still applies, but the limit on what you can earn in savings interest before paying tax is £500 rather than £1,000. Top rate taxpayers do not have a PSA. 

If you were a non-taxpayer at the time you received your compensation offer you are entitled to claim back 100% of the tax deducted from your offer, as long as that amount would not move you up into the basic rate tax bracket.

HMRC rules state you can only claim back tax from four years ago, so the clock started as soon as you received your offer of compensation.

A simple example for a basic rate taxpayer is someone whose PPI offer included £1,000 of statutory interest and did not earn any other interest from elsewhere in that year. The £1,000 they received from their PPI interest does not exceed their PSA and so they should not have had the 20% tax deducted and are due all of it back, which would be £200.

An example for a higher rate taxpayer would be someone whose PBA offer included £500 of statutory interest and did not earn any other interest from elsewhere in that year. The £500 they received from their PBA interest does not exceed their PSA and so they should not have had the 20% tax deducted and are due all of it back, which would be £100.

Claims are processed by HMRC, so are always at the mercy of their workloads. Currently we are aware of very high volumes of submissions and staff limitations at HMRC, so claims are taking longer than usual but the sooner you put your claim in the sooner you can expect your cheque if your claim is successful.

Our fee for Tax Reclaim services is 36% inclusive of VAT on the financial award made by HMRC. 

To pursue the repayment of tax on your savings interest directly with HMRC. You will need a Government Gateway User ID and password and will have to complete an R40 form.

Discretionary commission arrangements (DCA) was the term given to a practice used by lenders and brokers where they changed the interest rates offered on vehicle finance to customers at their own discretion. As many customers were not told about the commission or offered other rates this practice was deemed unfiar by the FCA in January 2021 and banned.

The amount you could receive in compensation will depend on what the best rate interest rate available was at the time and the % you paid in interest, and also how much money you took out on finance and over what period.

The FCA are currently conducting a major investigation into unfair car finance, with the outcome expected to be announced on 25th September. While complaints can be logged immediately, a final repsonse won’t be delivered until 8 weeks after the FCA outcome has been announced.

In line with the FCA financial claims management cap, the amount you pay to us as a fee will be depednednt upon how much compensation you receive.

When lenders and brokers arranged PPI policies they built high levels of commission into the premiums, without disclosing these to the customer. Research by the Financial Conduct Authority found that on average this commission made up 67% of the premiums and following a landmark court case set new rules which entitled many more consumers to make a claim.

If your lender is found to have not disclosed an unfairly high commission on your policy then you are due all the commission payments back. How much this will be in your case depends on the commission levels involved as well as how long you had the PPI policy for, but in one landmark case a couple were awarded over £17,000.

Packaged Bank Accounts, or PBAs, are current accounts that offers perks such as travel insurance, breakdown cover or a free overdraft in exchange for a monthly fee.

Each claim is different, depending on the type of account you held, the monthly fee and how long you had the account for. Our average successful mis-sold PBA claim is for £1,216 (as at March 2021).

Once you’ve registered your interest a member of our team will contact you to understand your circumstances and get the details of your claim. We then compile and send your complaint on to the bank and if successful they will issue you with an offer of compensation plus interest.

We don’t always need your bank account number in order to submit your complaint but in cases where we do, you are entitled to contact the bank directly and request it from them.

If you do receive a PBA offer, most lenders will pay the compensation into any open bank account you have with them, the same day the offer is made. If you do not have an open account with them, they will send a cheque instead.

Not at all. You are protected by the Financial Conduct Authority’s ‘Treating Customers Fairly’ initiative, which protects your rights. This therefore prevents your relationship with your bank being affected by a mis-sold PBA complaint.

Investigating a PBA claim does not affect your credit rating or credit limit. Providers will not add the details of your claim, or any compensation you receive, to your credit record.

A pension may have been mis-sold at point of sale, during a transfer or whilst giving advice. Anyone involved in selling or consulting on pensions should have ensured they knew all their client’s circumstances, and should be able to demonstrate that they considered these before recommending or selling any financial investment, as well as their client’s appetite to risk. They should have fully disclosed all information relating to the products, the risks involved and any possible disadvantages to the client if they left their previous pension in the case of transfers. At all times advisors and salespeople should be regulated to advise on pensions and have provided necessary regulatory documentation, as well as disclosing any commission they would receive from the sale, transfer or advice to the client. You have 6 years from the point of sale or when the advice was given to make your complaint, or if the sale/advice took place more than 6 years ago if you have only become aware of potential mis-selling in the last 3 years. If the pension provider or advisor is no longer trading, we may be able to investigate much further back than this.

Pension claims, like the products themselves, are very complex and each case is different. Compensation for mis-sold pensions considers many factors such as how long ago the mis-selling took place, the extent of financial loss to the consumer and the number of breaches made by the advisor or salesperson.
For some of the worst cases of mis-selling from firms no longer trading, the Financial Services Compensation Scheme (FSCS) says there was a 15% increase last year in the number of cases where consumer losses were over their compensation limit of £85,000.
